1. Acceptance of Terms

By using the Muon Marketing website, engaging our Services, or paying an invoice, you agree to be bound by these Terms of Use and our Privacy Policy.

2. Service Disclaimers

Agency Services: We do not guarantee specific search engine rankings or #1 positions. Search engine policies and algorithms change frequently; past performance and ROI calculators are for illustrative purposes only.
Educational Services: Our training programs provide information only. We do not guarantee specific income results. We are not a “business opportunity” or “business in a box.”

3. The "No Handcuffs" Payment Model

Billing: Services are billed on a recurring 30-day cycle.
Cancellation: You may cancel at any time. Written notice must be sent to [email protected] at least three (3) business days prior to your next billing date.
Refunds: Payments are non-refundable. Service continues until the end of the currently paid cycle.
Chargebacks: You agree to contact us to resolve disputes before initiating a chargeback. Unauthorized chargebacks may result in blacklisting.

A core component of our Service is Lead Tracking. In this capacity, Muon Marketing acts as a Data Processor.

We collect data about your customers (“End Users”)—such as call recordings and form submissions—solely to provide analytics to you.
The Client acts as the Data Controller and is responsible for obtaining all necessary consents from End Users (e.g., call recording disclosures).

4. Intellectual Property

Client Materials: You retain ownership of materials you provide to us.
The Grid & Background Tech: Muon Marketing retains all rights to proprietary methodologies, “The Grid” strategy, custom automation scripts, and AI models. You are granted a license to use the output for your internal business.
Web Design: Upon full payment, you own the HTML/CSS of your site. However, licenses for third-party premium plugins (e.g., Elementor Pro) may require your own subscription if you terminate maintenance services.

5. Limitation of Liability

To the fullest extent permitted by law, Muon Marketing LLC’s total liability for any damages shall not exceed the amount of fees paid by you to the company during the three (3) months immediately preceding the claim. We are not liable for consequential, incidental, or punitive damages.

6. Workflow Automation & AI

AI Accuracy: You acknowledge that AI-generated content may contain inaccuracies. You are responsible for reviewing and approving all content before publication.
Platform Dependency: We are not liable for service interruptions caused by third-party APIs like Zapier or OpenAI.

7. Mobile Messaging Terms

We use your phone number to send marketing, appointment and update texts. We do not share your mobile phone number with third parties for their marketing purposes.

8. Governing Law

These terms are governed by the laws of the State of Washington. Any legal proceedings shall be instituted exclusively in the courts of Clark County, Washington.
